Republicans, make up your minds.

Mitt Romney, as a Republican governor in 2004, said it's the job of the legislature, not the courts, to decide marriage equality. He repeated that claim this year when a judge in Iowa struck down that state's ban on same-sex marriage.

Conversely, Arnold Schwarzenegger, also a Republican governor, has said in both 2005 and 2007 that it's the job of the courts, not the legislature, to decide marriage equality.

They can't both be right.

I believe they can both be right. Though, each of them is missing something. There is no Constitutional restriction on gay marriage so, the courts should uphold the rights of consenting adults to unite under the law.

However, the legislature has the ability to change the laws and amend the Constitution. In this case, the courts should step in to denounce a Constitutional amendment that prohibits citizens of consenting age to engage in personal mutual relations in the privacy of their own homes.

The government has no right to tell anyone who they can or cannot unite with as long as they are not infringing on the rights of others, overtly. No rights are violated for a marriage consisting of a man and a woman unless one or both of them engages in extramarital activities with one or more of the other couple.
